3. Communication Preferences

3.1 Your Intent to be Contacted

You understand and agree that by submitting your contact information through our Site and requesting that we contact you, you are providing your prior express invitation and permission to be contacted by DapperTails at the telephone number(s) you provide, and that this consent is  intended to, and does, supersede and override any prior or current registration of your number(s) on any federal, state, or internal Do Not Call list or registry. This means that even if your number is registered on the National Do Not Call Registry or any similar state registry, you are expressly authorizing DapperTails and its agents to contact you by call and/or text (SMS) at that number

for the purposes described in this Privacy Policy. When you provide your phone number and separately check the dedicated consent box for marketing communications (which is not pre-selected) or otherwise affirmatively agree to receive such communications on our Site, you give your prior express written consent to receive marketing emails, calls, and text (SMS) messages from DapperTails at the number provided. This consent includes messages sent using an automatic telephone dialing system or an artificial or prerecorded voice. You agree that entering your name and submitting the form on our Site constitutes your electronic signature, which has the same legal effect as a handwritten signature and evidences your agreement to and consent

under this Section. This consent remains in effect until you withdraw it as described in Section 3.4 below, and your withdrawal of consent will not affect the validity of any communications made before we process your request.

3.2 How We May Contact You

If you submit your information through our Site (for example, by completing a contact form, requesting information, booking a service, or otherwise providing your contact details), we may contact you by telephone, email, and/or text (SMS) message using the contact information you provide. We will do so to respond to your inquiry, to provide information about our products, services, and franchise opportunities, and to schedule, confirm, coordinate, and manage your appointments, including coordinating service arrivals and timing, sending arrival or status notifications, and handling rescheduling, cancellations, and reminders. In addition, once we

provide services to you and establish a business relationship, you understand and agree that we may also contact you by telephone, email, and/or text (SMS) message for purposes arising out of or related to that business relationship, including servicing your account, following up on completed services, and providing information about additional or related products and services.

3.3 Message Frequency and Charges

Consent to receive marketing or promotional calls and texts is not a condition of purchasing any property, goods, or services. Message frequency varies. Message and data rates may apply.

3.4 Opting Out and Withdrawing Consent

You may opt out of marketing emails at any time by using the unsubscribe link in the email. You may opt out of marketing text messages at any time by replying STOP to any message from us; you may receive a final confirmation message after you opt out. For help, reply HELP or contact us at info@dappertailsfranchising.com. You may opt out of marketing telephone calls by informing us during a call. You may also withdraw your consent to any calls, emails, and texts at any time by contacting us directly at info@dappertailsfranchising.com. We will honor your opt-out request within a reasonable time as required by applicable law.

We do not sell, trade, or share your phone number or SMS opt-in data with third parties for their own marketing purposes. We may share this information with service providers solely to the extent necessary to deliver our messages and operate our communications programs on our behalf.

Our Sites are intended for a general audience and are not directed to children. Children under the age of 18 are not permitted to use our Sites, and we do not knowingly collect personal information from anyone under 18. Your Rights and Choices

The CCPA provides consumers (California residents) with specific rights regarding their personal information. This section describes your CCPA rights and explains how to exercise those rights. Right to know and Data Portability

You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months (the "right to know"). Once we receive your request and confirm your identity, we will disclose to you:

  • The categories of personal information we collected about you.

  • The categories of sources for the personal information we collected about you.

  • Our business or commercial purpose for collecting or selling that personal information.

  • If we sold or disclosed your personal information for a business purpose, two separate lists disclosing:

Right to Delete

You have the right to request that we delete any of your personal information that we collected

from you and retained, subject to certain exceptions (the "right to delete"). Once we receive your

request and confirm your identity, we will review your request to see if an exception allowing us 

to retain the information applies. We may deny your deletion request if retaining the information

is necessary for us or our service provider(s) to:

  • Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, or otherwise perform our contract with you.

  • Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).

  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information's deletion may likely render impossible or seriously impair the research's achievement, if you previously provided informed consent.

  • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.

  • Comply with a legal obligation.

  • Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

  • We will delete or deidentify personal information not subject to one of these exceptions from our records and will direct our service providers to take similar action.

Exercising Your Rights to Know or Delete

To exercise your rights to know or delete described above, please email us at info@dappertailsfranchising.com. Only you, or someone legally authorized to act on your behalf, may make a request to know or delete related to your personal information. You may also make a request to know or delete on behalf of your child (children under the age of 18 are not permitted to use our Sites). You may only submit a request to know twice within a 12-month

period. Your request to know or delete must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.

  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. You do not need to create an account with us to submit a request to know or delete.

Response Timing and Format

We will confirm receipt of your request within ten (10) business days. If you do not receive confirmation within the 10-day timeframe, please contact info@dappertailsfranchising.com. We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Personal Information Sales Opt-Out and Opt-In Rights

We do not sell your personal information.

Non-Discrimination

We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by

the CCPA, we will not:

  • Deny you goods or services.

  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.

  • Provide you a different level or quality of goods or services.

  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

  • However, we may offer you certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels. Any CCPA-permitted financial incentive we offer will reasonably relate to your personal information's value and contain written terms that describe the program's material aspects. Participation in a financial incentive program requires your prior opt-in consent, which you may revoke at any time.

 

Other California Privacy Rights

California's "Shine the Light" law (Civil Code Section § 1798.83) permits users of our Site that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes.
